This is a book about the choice of governments to use the World Trade Court of the World Trade Organization to adjudicate disputes with other governments. The alternatives are either to do nothing or to engage in direct negotiations with those other governments. The author argues that democratic governments tend to use the Court to insulate themselves from direct pressure from private interests groups so that their citizens can continue to enjoy greater degrees of trade liberalization overall. The author’s careful analysis of data on trade disputes leads her to assert, in addition, that the outcomes are better when governments avail themselves of these forums for dispute resolution. Thus, the apparent trend toward “legalization” is a pragmatic response of governments to the domestic political pressures that result from globalization of the world economy.
